The TMT (Technologies, Media and Telecommunications) team of CA– Cambule & Américo, Sociedade de Advogados, has just submitted its contributions to the Proposal for a Cybersecurity Law on the website platform of the National Institute of Information and Communication Technologies ( INTIC, IP).
In addition to suggestions for the textual construction of some provisions, the contributions are essentially around the following points:
- The Principles that guide the interpretation and application of the rules of the Law;
- The relationship and harmonization of the Bill with the Cybersecurity Policy and Strategy and the African Union Convention on Cybersecurity and Data Protection;
- The harmonization of the Proposed Law with other legal diplomas, with regard to the ICT regulated authorities;
- The obligations of some sectors of government vulnerable to cybercrime;
- The obligation to retain personal data; and
- Mechanisms for notifying security incidents to the competent authorities.
CA remains alert to the legal developments in this sector and hopes that the country will soon have a clear and consistent legal framework around it.
